"As a rule, foreigners register their luxury boats on transparent structures, without hiding themselves. In such structures, the shareholder is visible. And Russian businessmen are no exception. The transparency of ownership of such yachts by Russians is due to issues of limiting the liability of the owner for boats. This is done in order to make it clear , who to ask if such a yacht becomes a participant in a marine incident, for example, if it rams a seiner," says Alexander Zakharov.

At the same time, there are opportunities for Russian oligarchs to remain anonymous, and they are willing to use them. "When registering in the Caymans, BVI and Bermudas, this can be done in two ways: either by registering the shares of the company that owns the ship on a trust, or through the use of nominal owners," the expert knows.

According to him, since the registration of a yacht occurs through the establishment of a corporate structure (for example, a trust) in these Caribbean islands, this may entail an obligation for Russian taxpayers to notify the Russian tax service as part of the disclosure of information on controlled foreign companies. "However, such an obligation will not arise if a Russian loses the status of a tax resident in Russia," the source concludes.

"A", named as it is supposed, in honor of the wife of the oligarch - a former Serbian model Alexandra (Sandra) Nikolic can accommodate up to 20 guests on board. At their service - a spa club, a beach with three pools, a garage for four cars (if you need to go on land) and a submarine - for sea voyages. A special room, equipped in the lower deck, allows you to monitor the life of the sea depths through a panoramic camera, and one of the decks is reserved for a helipad. It took 1,300 trunks of expensive teak wood to finish the yacht.

The yacht is served by a crew of 54 people. The cabin of Andrei Melnichenko himself, according to the press, is protected by bulletproof glass, and 50 video surveillance cameras are also installed on the ship for security purposes. This is how Andrey Melnichenko's lawyers assess the situation with the yacht "A", they are sure that the arrest from the vessel will be lifted within a few days. The issue of non-payment is subject to arbitration in the UK, where it will be considered (port of registry "A" - Hamilton in Bermuda). At the same time, representatives of the oligarch say they are amazed at the actions of Nobiskrug: some issues with the shipyard really remained unresolved, but no one shied away from discussing them. “We assumed that things were moving towards mutual agreement and sending the yacht to Spain” lawyers comment. In particular, Andrey Melnichenko's representative Alex Andreev told the media that the funds, pending resolution of the situation, transferred to a special deposit account.

And 9, and even 15.3 million dollars with a total capital of 13 billion do not look serious. But it may turn out that this is not the only debt associated with yacht "A". Before leaving for the Pyrenees, the ship called at the Norwegian port of Christianssen for two days. Some commentators do not rule out that the route was specially laid out in such a way as to “save” 70 million VAT along the way. A yacht manufactured in Germany for a foreign customer is subject to taxation in the country of operation. This rule was introduced by the German financial service in order to avoid double taxation. The condition is that the country of operation should not be a member of the EU, Norway is quite suitable for this. To obtain VAT exemption in Germany, all you need is Norwegian signatures and seals confirming your stay in the kingdom.

“The manufacturer in this case indicates the price without VAT on the invoice and notes the presence of an export delivery”, - explain in the Ministry of Finance of Germany. The risk for the manufacturer lies in the fact that the customer may subsequently simply “forget” to receive the necessary papers. The seller in such a case may require the payment of VAT from the buyer, and then, after the presentation of export documents, refund the VAT.

The conditions under which the yacht "A" was purchased from Nobiskrug were not disclosed. Based on a cost of 400 million euros, VAT could be approximately 70 million. Representatives of Andrey Melnichenko declare that all the required tax obligations are being met, the shipyard has not yet commented on the tax issue.
